Welcome to Talltale, an AI story generation tool owned by Form LLC (hereafter referred to as "Talltale"). By accessing or using Talltale, you agree to be bound by these terms and conditions (the "Terms"). If you do not agree to these Terms, you should not access or use Talltale.

1. Use of Talltale

Users may view and read public stories on Talltale. Subscribing users may use Talltale's AI tool to generate their own stories, characters, and images.

2. Support

Talltale offers support through a Wiki and email support for subscribing users.

3. Prohibited Uses

Talltale prohibits the use of its platform for violent, sexual, racist, or hate speech content. Talltale is targeted at children and will have content filters in place to monitor and remove any such content. Users may flag any inappropriate content they encounter on Talltale.

4. Warranties and Disclaimers

Talltale is an AI generative tool and, as such, some generated results may be unexpected or need to be regenerated to achieve an acceptable level. Talltale is a design and collaboration tool that allows users to control the output based on prompts. Talltale does not make any warranties or guarantees regarding the quality, accuracy, or reliability of its generated content.

5. Ownership of Content

Public stories generated on Talltale belong to Talltale and may be used by Talltale for any purpose. Subscribing users who create stories using Talltale's AI tool retain the ownership of their stories. However, by using Talltale's AI tool, subscribing users grant Talltale a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display their stories for promotional purposes.

6. Termination

Talltale reserves the right to terminate access to its platform for any user who violates these Terms.

7. Modifications

Talltale may modify these Terms at any time, and such modifications will be effective immediately upon posting on Talltale's website. Your continued use of Talltale after any modification of these Terms constitutes your acceptance of such modification.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington.

9. Intellectual Property

All intellectual property rights, including but not limited to trademarks, copyrights, patents, and designs, in Talltale are owned by Form LLC.

10. Limitation of Liability

To the extent permitted by law, Form LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use Talltale; (b) any conduct or content of any third party on Talltale; (c) any content obtained from Talltale; and (d) unauthorized access, use or alteration of your transmissions or content.

11. Indemnification

You agree to indemnify and hold harmless Form LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of Talltale, by you or any person using your account and password, or b) a breach of these Terms.

12. Dispute Resolution

Any disputes arising out of or related to these Terms or your use of Talltale will be governed by the laws of the State of Washington, without regard to its conflict of laws rules. All claims arising out of or relating to these Terms or Talltale will be litigated exclusively in the federal or state courts of the State of Washington, and you consent to personal jurisdiction in those courts.

13. Account Security

You are responsible for safeguarding the password that you use to access Talltale and for any activities or actions under your password, whether your password is with our service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
